    Terms and conditions

    DISTANCE CONTRACT

    This distance contract (hereinafter – the Contract) is concluded between the owner of the Internet trading site www.greenum-wp.iconcept.lv “COSMETIC LAB” Ltd, registration No. 40103863637, address: 322a Maskavas Street, Riga, Latvia, LV-1063 (hereinafter – the Seller), and a buyer who is at least 14 years old and who places an order and makes a purchase on the Internet trading site www.greenum-wp.iconcept.lv (hereinafter – the Buyer). The Distance Contract applies to all orders and purchases made on the www.greenum-wp.iconcept.lv Internet trading site (hereinafter – the GREENUM Site). This Distance Contract does not apply to purchases made by the Buyer on any other websites or physical retail outlets of the Seller.

    General Terms

    1. The Buyer orders, purchases and pays for, and the Seller delivers and sells, body, facial, hair, bath and other cosmetics and goods (“Goods”) in accordance with the terms of this Agreement.

    2. The Buyer purchases the Goods by filling in the relevant order form on the GREENUM website. When placing an order, the Buyer undertakes to provide accurate information, i.e. name, delivery address and contact details. The Buyer undertakes to inform the Seller of any changes by e-mail to sales@cosmetic-lab.lv no later than 24 hours after receipt of the order confirmation. The Buyer is responsible for providing the correct details, otherwise the delivery of the Goods may be delayed or not possible. The ordering of the Goods shall be deemed to constitute an offer by the Buyer.

    3. The Seller enters into this Agreement for the delivery of the Goods ordered and the Buyer agrees to purchase the Goods ordered at the price quoted. By placing an order, the Buyer acknowledges that it has read, understood and agrees to the terms of the Contract and undertakes to observe and comply with them. The Customer is not permitted to place orders unless the Customer has read and agreed to the terms of the Contract. The Contract has been prepared in accordance with the laws and regulations of the Republic of Latvia.

    4. The Agreement applies to different types of Customers, both non-registered Customers and Members as referred to in the COSMETIC LAB Loyalty Programme Terms and Conditions, who receive additional benefits and discounts.

    Purchase and delivery

    5. The prices of goods on GREENUM are in EUR. All prices include any applicable value added or other taxes. Goods are sold at the prices prevailing at the time the order is placed. Surcharges may be included in the total delivery price. Depending on the bank or payment method used by the Buyer, bank charges may apply.

    6. Payment for the Goods is made by the Buyer at www.greenum-wp.iconcept.lv by debit or credit card (MasterCard, Visa, Maestro, Visa Electron) or by bank transfer to the account number of COSMETIC LAB Ltd as stated on the pre-paid invoice. All delivery costs are to be paid by the Buyer.

    7. The Seller delivers the Goods to the address specified by the Buyer in accordance with the rates set by the delivery service. The Buyer pays the shipping costs and the Goods together, prior to receipt of confirmation and delivery of the Goods from the Seller. The delivery price is included in the invoice. The electronic invoice is valid without signature.

    8. The Buyer undertakes to sign a receipt for the Goods at the time of delivery.

    9. The Buyer may place orders 24 hours a day, but the Seller completes orders: on weekdays from 9.00 a.m. to 5.00 p.m., on Saturdays, Sundays – no completion. The Seller sends the Buyer a confirmation of acceptance of the order by e-mail. If the Buyer does not receive a confirmation e-mail, the order is not accepted. The order is completed when the money is transferred to the Seller’s account.

    10. The estimated delivery time is indicated at the time of purchase, in the Buyer’s account and is sent in the purchase confirmation email.

    Quality guarantee and liability

    11. The Seller accepts no responsibility and makes no warranty that the goods will always meet the Buyer’s expectations beyond those stated in the product description. If the Buyer is not satisfied with the quality of the goods, the Buyer may return the particular goods upon receipt of the order and receive a full refund for the particular goods.

    12. The goods displayed on the GREENUM website may differ slightly from the same size, shape and colour as the goods received due to the technical characteristics of the various devices used to order the goods or other reasonably foreseeable differences.

    13. The characteristics and instructions for use of all goods sold on the GREENUM website are set out in the product description accompanying each product.

    Rights of return and refund

    14. The Buyer may exercise the right of withdrawal contained in the Consumer Rights Protection Law of the Republic of Latvia and return the Goods within 14 calendar days. In order to avoid any disputes, upon receipt of the Goods, the Buyer must make sure that they correspond to the order (colour, product name and other relevant parameters).

    15. In the case that the Goods are not assembled correctly, the Buyer has the right to exchange the Goods within 14 days by completing a return form. Courier costs in the above case are to be borne by the Seller.

    16. If the Buyer wishes to exercise the right of withdrawal, the following recommendations and conditions applies:

    16.1. If the condition of the returned Goods has deteriorated due to improper storage, the Buyer is not entitled to exercise the right of withdrawal.

    16.2 The Buyer is obliged to preserve and not damage the original packaging of the Goods.

    16.3 If the Buyer wishes to use the right of return, the Buyer must return the goods received together with the cancellation form to the Seller by post.

    16.4 The Buyer is obliged to retain both the courier documents for receipt of the Goods and the postal/courier documents for return of the Goods to the Seller.

    16.5 The Buyer may obtain further information on what constitutes a distance contract and the right of withdrawal at the following website address: www.ptac.gov.lv.

    16.6 The Seller transfers the money for the Goods to be returned and their delivery costs to the bank account specified by the Buyer in the cancellation form within 14 working days after termination of the Contract and receipt of the Goods specified in the cancellation form at the Seller’s warehouse (Maskavas 322A, Riga, Latvia, LV 1063) on the basis of the Buyer’s withdrawal.

    17. Buyer’s rights in case of non-conforming Goods:

    17.1 Defective Goods are rectified and non-conforming Goods are replaced or returned in accordance with the procedures set out in these Conditions and taking into account the requirements of the applicable laws of the Republic of Latvia;

    17.2 The Buyer who wishes to complain about defective or incomplete Goods may do so by sending the information and a cancellation form about the allegedly defective Goods by e-mail to: sales@cosmetic-lab.lv;

    17.3 When submitting a complaint, the Buyer must provide the following information:

    17.3.1. the invoice and order number of the Goods. If possible, the Buyer should attach the invoice to enable the Seller to deal with the Buyer’s complaint as soon as possible;

    17.3.2. specify the defect, signs of defect or missing part of the Goods;

    17.3.3. provide other evidence, such as a photograph of the Goods, a photograph of the defective area (if it is a mechanical defect and can be photographed), a photograph of the packaging of the Goods, etc.

    17.4 When submitting a complaint, the Buyer has the right to initially demand that the Seller or service provider remedy the non-conformity of the goods with the terms of the contract or replace the goods with goods that would conform to the terms of the contract, except where this is impossible or disproportionate (Section 28(2) of the Consumer Rights Protection Law).

    17.5 Upon examination of the complaint, a reply is provided within 14 days from the date of receipt of the complaint. If for objective reasons it is not possible to reply to the Buyer’s complaint within that period, the Seller immediately informs the Buyer in writing, indicating a reasonable period within which a reply will be provided and justifying the need for such an extension.

    17.6 Only if the Seller has established that the Goods are of substandard quality may the Buyer’s request for substandard Goods be fulfilled. The Customer Service Centre will arrange a refund to the payment account used to place the order. The Seller reserves the right to request the Customer to return the defective Goods to the Store.

    Final terms and dispute settlement

    19. If the Seller breaches the Contract, the Seller is only liable for the Buyer’s direct damages resulting directly from the breach.

    20. The Seller is entitled to modify the Contract in whole or in part or to suspend the GREENUM website. The Seller will notify the change or termination of the GREENUM Site by means of notices on the GREENUM Site and/or in the Seller’s shops and/or by e-mail to each Buyer and will seek the Buyer’s confirmation of the current version of the Agreement before any new purchase/order.

    21. The Contract remains in force until all obligations between the Seller and the Buyer have been fulfilled.

    22 The Contract is made in accordance with and governed by the laws of the country from which the Buyer is supplied with the Services and any dispute is to be settled by the courts in the jurisdiction in which the Seller’s company involved in the dispute is established.

    23. If a court or other competent authority holds that any provision of the Contract is contrary to law, incorrect or unenforceable, the ruling does not affect the validity and full enforceability of the remaining provisions of the Contract in accordance with the laws and regulations.

    24. The Seller reserves the right to block the Buyer’s ability to make purchases on GREENUM for a limited or indefinite period of time in the event that fraudulent activities are detected or if facts are ascertained about a particular person’s previous fraudulent activities on GREENUM.  Fraudulent activities may be defined as both fraudulent activities and other activities that may interfere with the operation of the Seller or the GREENUM Site and/or cause direct or indirect damage.

    25. Disputes between the Buyer and the Seller are to be settled by mutual negotiation. If the Seller and the Buyer cannot resolve the dispute through negotiations, then the Buyer may file a complaint with the Consumer Out-of-Court Dispute Resolution Commission located at 55 Brīvības Street, Riga, Latvia, LV-1010, which resolves consumer disputes (more information on dispute resolution is available at www.ptac.gov.lv) or apply to court. In addition to the above, the Buyer may use an electronic dispute resolution platform (ODR) to resolve disputes regarding goods or services purchased on the Website.     Processing of personal data

    26. The Buyer’s personal data will be used to identify the Buyer and to receive orders, to process and deliver orders, to prepare accounting documents, including invoices, to refund overpayments and to refund amounts for returned goods, to administer financial and other obligations arising from this Agreement and other documents of cooperation between the parties, as well as for the use of the services offered on the GREENUM website.
